Sydney, Australia: The upcoming release of the Nepali feature film Batulo Jun has been plunged into controversy. HimaRoo Entertainment Pty Ltd, which acquired exclusive distribution rights for Australia and New Zealand, has accused the film's production team of breach of trust and selling the same distribution rights to another party behind their back.
According to Prem Prasad Dhami (Pramez), Director of HimaRoo Entertainment, their team had entered into an official distribution agreement with Sunrise Pictures Pvt. Ltd. and disbursed the agreed advance amount. However, just as final preparations for the theatrical release were underway, they discovered that the filmmakers had also signed a deal with another group for the Australian territory.
"We purchased the theatrical distribution rights for Australia and New Zealand, paid the required sum, and executed a formal contract," Dhami stated. "Now, right before the scheduled release, we have learned that the Batulo Jun team sold the film to another party. We have been severely hit by this breach of faith, and we are moving forward with legal proceedings against the production house."
Dhami further characterized the producers' actions as a severe lapse in professional ethics. "For established banners and veteran industry figures to engage in such deceitful behavior is truly damaging to the entire film industry," he added. "It does nothing but tarnish the reputation of Nepali cinema internationally."
According to the distribution agreement, Sunrise Pictures Pvt. Ltd. had appointed HimaRoo Entertainment Pty Ltd (jointly with Vishika Films Pty Ltd) as the exclusive theatrical distributor for Australia and New Zealand. HimaRoo representatives stated that they have already fulfilled necessary legal formalities, arranged cinema bookings, and invested millions of rupees in advance payments and marketing preparations.
HimaRoo also voiced strong criticism against the second group attempting to acquire "worldwide rights," noting it was inexcusable to pursue a deal while fully aware that theatrical rights for Australia had already been granted and secured under contract.
Faced with substantial financial exposure due to the production team's alleged double-dealing, HimaRoo has initiated legal action seeking full financial compensation and damages. In addition, the distributor has formally filed a complaint regarding the dispute with the Film Development Board in Nepal.
The company issued a firm warning: "If this contract is violated and our rights are disregarded, we will not allow Batulo Jun to screen in Australia under any circumstances. We will pursue our legal remedies and claim full damages until justice is served."
